Terms of purchase (baseline measurement, the Netherlands)
Version 1.3, effective from 22 August 2026. (New in version 1.3: §3 now states the self-service range: from 10 up to and including 5,000 employees in one legal entity. Neither number is new as a practice, but the upper one was not written down, and from today the order flow enforces it. Above 5,000 employees the Commuting Scan, the analysis with people in it, costs the same or less than the automated report, so we set the survey up with you instead of selling you the more expensive option over the counter. Prices below the limit are unchanged. New in version 1.2: §2 has been corrected to describe the delivery you actually receive. The survey, the dashboard, the report, the order confirmation and the invoice are in Dutch; these terms are in English and remain the binding text. §2 also no longer states that the report contains no absence potential: the monetary figure is still omitted, and the report does show self-reported absence days. And §6 now says expressly that Lerka does not issue a label or a certification, matching the Norwegian terms of 20 August. None of these changes narrows any right you had under version 1.1. The changes from version 1.0, effective from 12 August, were that §3 no longer prints the rate, so that the price shown at ordering is the price that applies, that the 20 percent advance-payment discount was removed from §4, since it was decided but never built and could not be chosen anywhere in the order flow, and that §15 on the Commuting Scan was added. Version 1.1 was effective from 13 August.) Prices are stated excluding VAT. All amounts are in euros.
1. Who the agreement is between
The agreement is entered into between Cadence AS, organisation number 912 024 652 (a Norwegian company, "we", "Lerka"), and the business placing the order ("you", "the customer"). By ordering, you confirm that you are authorised to bind the business.

The agreement is concluded when you have completed the order and received an order confirmation by email. Electronic acceptance is binding.
The service is sold to businesses only, never to consumers.
2. What you are buying
The baseline measurement is a survey-based account of your business's commuting, delivered as a report. The delivery consists of:
- an anonymous survey for your employees, with a link you share internally
- a dashboard showing the response rate while the survey is open
- ready-made reminder texts you send in your own channels
- a report with the modal split, the cost picture, the barriers, the convertible potential and a prioritised action plan, as PDF and on the web
The report combines your responses with public statistics. Every figure that comes from public statistics is marked [E] for estimate. The method and every factor, with source references, accompany the report.
Three things you should know before ordering, and each of them is deliberate:
- The survey, the dashboard, the report, the order confirmation and the invoice are in Dutch. These terms are in English, and the English text is the binding version. Employees respond best in their own language, and the response rate is what carries the report's confidence level.
- The CO₂ figure uses the Dutch national emission factor list (fleet average per vehicle kilometre, maintained by Rijkswaterstaat and Stichting Stimular) and is marked [E].
- The report contains no absence potential in money. The Netherlands has no official rate for what a day of absence costs, and the industry figures in circulation lack a documented method. We omit the monetary figure rather than present it as official. The report does show self-reported absence days, without attaching a cost to them.
Where a factor is missing for the Netherlands, the section is omitted and the report's method chapter says why. We never fill a gap with a figure from another country.
The employee count used in the report is the one you provide at ordering; the report does not include a register cross-check.
This is not: an audit, a certification, or legal or tax advice. The report is a basis for decisions.
3. Price
The price is calculated from the number of employees you state at ordering, and is shown in full before you order. The price shown at ordering is the price that applies to your order: it is frozen when you order and does not change afterwards. The current rate is always shown on the order page, lerka.app/nl/order.
The baseline measurement is self-service and covers one legal entity with at least 10 and at most 5,000 employees. The floor exists because the report only shows figures for groups of at least five people, and below ten employees we can neither promise anonymity nor give you a figure you can use externally. The ceiling exists because above it the Commuting Scan, the analysis with people in it, costs the same or less: we would rather set the survey up with you than sell you the more expensive option over the counter. No Norwegian VAT is added. The service is invoiced without Norwegian VAT as a remotely deliverable service to a business outside the Norwegian VAT area. You are responsible for accounting for the VAT yourself under the reverse charge rules. Your VAT ID (btw-id) and your Dutch address must be provided at ordering, and both are stated on the invoice.
4. Payment
Payment is made when you unlock the report. Nothing is charged at ordering, and nothing is charged at all if you never unlock the report.
Card payments go through our payment provider. Card details never pass through our systems.
5. What you do, and what we do
You: share the survey link internally, state an employee count that covers the whole unit, and make sure the person ordering is authorised.
We: set up the survey, run the dashboard, generate the report and keep it available for download for at least 24 months.
6. Response rate, confidence level and the right to use the report
The report is always delivered. The confidence level is computed from the response rate and cannot be changed, by you or by us:

Lerka does not issue a label or a certification. What you can point to externally is the figure, the response rate and the method, with the measurement date. We both designed the scheme and perform the measurement, and a "verified" badge from us would suggest an independent control that does not exist.
7. Extension, at no cost
While the response rate is below 65 percent, we extend the response window by seven days at a time, at no cost, for up to twelve weeks from the start. We would rather recommend an extension than a report you cannot use.
8. Delivery
The report is made available when the response window closes. It can be downloaded for at least 24 months.
9. Cancellation and refund
You can cancel with one click, no reason needed, at any time until the report is opened. If you have paid in advance, the full amount is refunded.
Once the report is opened, the delivery is complete.
10. Data, the report and anonymous statistics
Survey responses are anonymous as a technical property: no names, email addresses, IP addresses or times of day are stored with a response. The employer only ever sees figures for groups of at least five people.
The report belongs to you. We use aggregated figures in benchmarks only when at least five businesses are included, and never in a way that could single out your business.
11. What the report must not be used for
The report describes the business as a whole. It must not be used for assessment, follow-up or monitoring of individual employees, and the underlying data does not permit it either.
12. Personal data
How we process personal data is described in our privacy statement. Our assessment is that the survey responses are not personal data, because they are never stored with any identifier. The anonymity design can be documented for your data protection officer.
13. Liability
Our liability is limited to the price of the delivery. We are not liable for indirect or consequential loss.
The limitation does not apply in cases of intent or gross negligence.
14. Changes, governing law and disputes
We may change these terms. An order is always governed by the terms in force when it was placed.
The agreement is governed by Norwegian law, excluding its choice-of-law rules and the CISG. Oslo District Court (Oslo tingrett) has exclusive jurisdiction over disputes arising out of or in connection with the agreement, compare the 2007 Lugano Convention article 23.
15. Commuting Scan
The Commuting Scan is the analysis with people in it: everything the baseline measurement contains, plus a method review with your team, a potential analysis fitted to your travel patterns, support for several sites with combined reporting, and a presentation of the result to your management in a meeting of its own. It is bought for one legal entity with one or more sites. Groups of companies (several legal entities) and reporting across countries are handled by quote; contact us.
Price: calculated from the size of your organisation and the number of sites, and shown in full before you order. The price shown at ordering is the price that applies. The employee count you state must cover the whole entity, as in §3, and the response rate in §6 is measured against it.
Payment: at ordering, by card or against an advance invoice with 14 days' terms. Delivery starts when the payment is registered. The Scan differs from the baseline measurement here, and the reason is an honest one: the delivery commits working hours from the start, with a method review and setup before the survey opens.
Cancellation: full refund with one click until the method review (the first agreed working meeting) has been held or the survey has received its first response, and in any case for at least five working days after ordering. The contact where we agree the time of the method review is not the meeting itself. After that the delivery is under way; if you still stop it, you pay for the work carried out and the remainder is refunded.
Start: we contact you within one working day of ordering to agree the method review and the setup, including what counts as one site and how groups are formed, since the report never shows figures for groups of fewer than five people.
If the response rate stays low, §7 applies here in full: the survey window is extended free of charge for as long as it takes within twelve weeks, and our recommendation is always a report you can use rather than one you cannot.
For the parties, the survey, the data, the anonymity and the liability, §1 and §5 to §14 apply correspondingly, with one exception: cancellation follows this section, not §9. The rules in §9 on refunds apply to the refund itself.
